Terms of Service

1. Acceptance of Terms

By accessing or using Beamware's web-based finite element method (FEM) solver ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Software.

2. Eligibility

You must be at least 18 years old to use the Software. By using the Software, you represent that you are legally capable of entering into binding agreements.

3. Free and Paid Plans

Free Version:

Users may run up to 100 FEM solves per month without charge. Free use is monitored by IP address or cookies.

Paid Version:

For USD $19.99/month (processed securely by Stripe), users receive unlimited access. Subscription fees are billed automatically until cancelled.

No Account Requirement:

Access does not require account creation. However, payment information for subscriptions is processed by Stripe and subject to their terms.

4. License and Restrictions

Beamware grants you a limited, non-exclusive, non-transferable license to use the Software for your personal or internal business purposes.

You may not:

  • Reproduce, distribute, sell, or sublicense the Software.
  • Use the Software for unlawful purposes.

5. Engineering Disclaimer

  • The Software provides results for informational purposes only.
  • Results are not guaranteed to meet engineering standards, codes, or safety requirements.
  • Users are fully responsible for verifying accuracy and suitability before applying results.
  • Any engineering design, construction, or implementation must be validated by a licensed professional engineer.

6. Limitation of Liability

  • Beamware provides the Software "as is" and without warranty.
  • To the fullest extent permitted by law, Beamware disclaims all liability for damages of any kind, including but not limited to direct, indirect, incidental, or consequential damages, arising from use of the Software.
  • You assume full responsibility for your use of the Software and any reliance on its results.

7. Termination

Beamware reserves the right to suspend or terminate access to the Software, free or paid, at its sole discretion, including but not limited to cases of misuse, abuse, or violation of these Terms.

8. Payment Terms

  • Subscriptions are billed in advance on a monthly basis via Stripe.
  • Users may cancel at any time, but fees already paid are non-refundable.
  • Structware may change subscription pricing with at least 30 days' notice.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts of Ontario.

10. Changes to Terms

Beamware may update these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.
